These Terms of Sale ("Terms") govern your purchase of products from Pure Apotheca Pty Ltd ("Pure Apotheca", "we", "us", or "our") via our online store located at https://pureapotheca.com. By purchasing from us, you agree to be bound by these Terms.

2.              PRODUCTS

                   2.1          We sell a curated range including but not limited to:

     Homewares, kitchenware, tableware

     Giftware, body care products, soft furnishings

     Perishable items (e.g. food, hampers)

     Christmas and Easter decorations

     Furniture and lighting (including custom-made and bulky items)

                   2.2          Due to the handmade or natural nature of some items (e.g. wood, marble, ceramics), minor variations in colour, texture or finish may occur. These are not considered defects.

3.              PRICING AND PAYMENT

                   3.1          All prices displayed on our website are in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) where applicable.

                   3.2          We reserve the right to change prices at any time without notice. However, once an order is placed, it will be processed at the price displayed at the time of order confirmation.

                   3.3          We accept the following payment methods:

     Credit/Debit Card (via secure payment gateway)

     PayPal

     Shop Pay

     Google Pay

     Afterpay (for eligible transactions)

                   3.4          All payments must be received in full before orders are processed and dispatched. Pure Apotheca does not accept payment via bank transfer, or cheque unless otherwise agreed in writing.

                   3.5          Promotional codes, discounts, or gift vouchers must be applied at the time of checkout. They cannot be applied retroactively to completed orders. Only one discount code or promotional offer can be applied per order unless explicitly stated otherwise.

                   3.6          Prices listed do not include shipping fees. Shipping costs are calculated and added at checkout based on the delivery method selected. Please see Clause 5 for more information on shipping and delivery.

                   3.7          We take care to ensure all pricing on our website is correct, but in the event of a pricing error, we reserve the right to cancel an order and issue a full refund if necessary.

4.              ORDER PROCESS

                   4.1          Orders placed through our website are considered offers to purchase and are subject to acceptance and availability.

                   4.2          After you place an order, you will receive an email confirmation acknowledging receipt of your order. This confirmation does not constitute acceptance of your order. Acceptance occurs only when we send a subsequent email confirming that your items have been dispatched.

                   4.3          We aim to process and ship all orders within 1–2 business days, unless otherwise stated. Orders placed on weekends or public holidays will be processed the next business day.

                   4.4          In the rare event that an item becomes unavailable after you place your order (e.g. due to stock error or in-store sale overlap), we will notify you as soon as possible. You will be offered the option of:

     Receiving a full refund for the unavailable item

     Selecting a suitable alternative (if available)

     Placing the item on backorder (if applicable)

                   4.5          Orders may be refused or cancelled at our discretion, for example, if there is a suspected pricing error, breach of these Terms, or a problem with payment processing.

                   4.6          If you need to make changes to your order (e.g. delivery address or items), please contact us as soon as possible — ideally within 24 hours of placing your order. However, please note that changes cannot be made once the order has been packed and/or shipped, even if this occurs within the 24-hour window. We recommend checking your order carefully before placing it to avoid disappointment.

                   4.7          It is your responsibility to ensure all order details are correct at the time of purchase. Pure Apotheca is not liable for delays or losses resulting from incorrect delivery details or failure to notify us of a change in time.

5.              SHIPPING

5.1          Notice Regarding Store Closures: Please note that Pure Apotheca observes an annual holiday closure from 25 December through to 31 January. During this period, our physical store is closed, and online orders will be processed and shipped 1–2 times per week only. Dispatch times may be delayed beyond our usual timeframes. We appreciate your patience during this period.

5.2          We may also experience temporary closures or dispatch delays due to unforeseen events, including but not limited to:

     Natural disasters

     Extreme weather events

     Public health emergencies

     Staff illness or bereavement (e.g. funerals)

In such cases, we will notify customers of any significant delays and provide updates via our website and/or email. Thank you for your understanding.

                   5.3          Domestic Shipping:

        Orders are shipped Australia-wide including PO Boxes.

        Flat rate standard shipping: $15 AUD

        Flat rate express shipping: $25 AUD

        Bulky items (e.g. furniture, lighting) incur additional charges calculated at checkout based on weight and postcode.

                   5.4          Delivery Timeframes:

        Standard shipping: 3–7 business days

        Express shipping: 1–3 business days

        Furniture and custom items: up to 2 weeks (or as stated in product description)

                   5.5          We use Australia Post and other courier services with tracking. Delivery times may vary due to external factors beyond our control (e.g. peak periods, natural disasters).

                   5.6          We do not offer international shipping by default but may consider requests on a case-by-case basis.

6.              RETURNS AND EXCHANGES

                   6.1          We want you to love your purchase from Pure Apotheca. If for any reason you change your mind, we accept returns and exchanges on eligible items within 7 days of delivery, provided the item is:

     Unused and in its original, saleable condition

     In its original packaging (where applicable)

     Accompanied by the original receipt or proof of purchase

     Please note that return shipping costs are your responsibility. We recommend using a trackable shipping method with insurance for items over $50. We are not liable for returned items lost or damaged in transit.

                   6.2          Items Excluded from Change of Mind Returns: We do not accept change of mind returns or exchanges for the following products unless the item is faulty:

        Furniture and lighting

        Perishable goods (e.g. food, drinks, hampers)

        Personal care products (e.g. soaps, skincare, body care)

        Soft furnishings (e.g. rugs, bedding, cushions, towels, soft toys)

        Earrings or jewellery

        Sale or clearance items

        Vintage, reclaimed, custom-made or made-to-order items

        Gift cards

                   6.3          Return Process:

a.             Email hello@pureapotheca.com within 7 days of receiving your order to request a return and state your reason.

b.             Await written confirmation from us before returning any items.

c.              Securely repackage the items to prevent damage in transit and post them to:

d.             Include a copy of your receipt or proof of purchase in the package.

e.             Once your return is received and inspected, we will notify you of the outcome. If approved, a refund will be processed to your original method of payment within 7 business days.

f.               Items returned in a damaged or unsaleable condition (due to use or insufficient packaging) may not be eligible for a refund.

g.             We reserve the right to reject returns that do not meet the above conditions.

h.             If you wish to exchange an item for a different size or variation, please follow the same return process and place a new order for the replacement item.

7.              FAULTY OR DAMAGED ITEMS

7.1          What To Do If Your Item Arrives Damaged: 

7.1.1    We understand how disappointing it is to receive a broken or damaged item. If this happens, please follow the steps below within 48 hours of delivery so we can help resolve the issue quickly:

      Take photos of the damage and the packaging (inside and outside).

      Retain all original packaging until we advise you that it can be discarded, as it may be required for courier claims or insurance assessments.

      Email us at hello@pureapotheca.com with all images and a brief explanation.

7.1.2    We’ll do our best to offer a suitable solution — whether that’s a refund, replacement or store credit — depending on the circumstances and availability.

7.1.3    We take great care in packaging your items securely, but occasionally, products may be damaged during transit or arrive with a manufacturing fault.

7.1.4    We aim to resolve such issues promptly and fairly, in line with your rights under Australian Consumer Law.

7.2          Reporting Process:

7.2.1    Email hello@pureapotheca.com with:

a.    A clear description of the issue

b.    Photographs of the damaged or faulty item

c.     Photos of both the outer and inner packaging

d.    Retain all original packaging until we advise you that it can be discarded, as it may be required for courier claims or insurance assessments.

7.3          Resolution Options:

7.3.1      Where items are received damaged in transit, we will review the issue and, depending on the nature of the damage and stock availability, may offer a refund, store credit, or replacement at our discretion.

7.3.2      We are not responsible for courier delays or mishandling, but we will work with you to resolve the issue appropriately and fairly under Australian Consumer Law.

7.3.3      Courier Handling Disclaimer: All orders are packed with care and dispatched using reputable courier services. Once dispatched, we are not in control of how parcels are handled in transit. We ask for your understanding and cooperation in lodging any necessary documentation to help us recover loss from our delivery partners.

7.3.4    Once we review the claim, we may offer one of the following:

• A replacement (where stock is available and appropriate)

• A store credit for the value of the damaged item

• A refund, if a replacement or store credit is not suitable or available

7.3.5    We aim to provide a response within 2 business days of receiving your claim.

7.3.6    We may waive the need to return the damaged item if it is not salvageable (e.g. shattered glass), but this is at our discretion.

7.4         Refunds do not include the original shipping fee. Our decision will be based on:

The severity of the damage

• Whether the item can still be used

• Availability of stock for replacement

7.5         In some cases, we may waive the need to return the damaged item (e.g. if it cannot be salvaged).

7.6        Important Notes:

a.    Refunds exclude the original shipping fee.

b.   Sale and clearance items are not eligible for replacement.

c.    If you do not notify us within 48 hours of delivery, you are deemed to have accepted the goods as   received and no refund, replacement or store credit will be available

d.   If you are returning faulty goods, return shipping is at your cost unless otherwise advised by us.

e.    Damage caused after delivery (e.g. during unpacking, misuse, or storage) is not covered.

f.     We reserve the right to request additional information or deny a refund or replacement if the claim is submitted outside the required timeframe or if the damage appears to have occurred after delivery.

8.               PRODUCT CARE AND USE

8.1          Proper use and care of your products help maintain their appearance and performance over time.

8.2          We encourage all customers to carefully read the product descriptions, labels, and care instructions before use.

8.3          General Use Instructions:

8.3.1    Use products only for their intended purpose.

8.3.2    Follow any included instructions or labels provided on or with the product.

8.3.3    Where applicable, store items in a cool, dry place and avoid prolonged exposure to moisture, heat, or direct sunlight.

8.4          Body Care and Skincare Products:

8.4.1    All body care items should be patch tested before full use. Apply a small amount to the inner arm and wait 24 hours. If irritation or sensitivity occurs, discontinue use immediately.

8.4.2    Our body care products are not therapeutic goods and are not intended to diagnose, treat, cure, or prevent any disease.

8.4.3    If you are pregnant, breastfeeding, or have sensitive skin or known allergies, consult your medical practitioner before using any skincare or body product.

8.5          Fragile and Handcrafted Items:

8.5.1    Many of our products are made from ceramic, glass, marble, or other delicate materials. Please handle with care.

8.5.2    Natural variations such as knots, grain differences, and minor imperfections are considered part of the product’s unique character.

8.5.3    Avoid submerging non-waterproof items and dry thoroughly after cleaning.

8.6          Soft Furnishings and Textiles:

      Always follow care labels and spot clean where required.

      Avoid placing in direct sunlight to prevent fading.

      Do not machine wash unless stated on the care label.

8.6.1    Disclaimer: Pure Apotheca will not be held liable for misuse of products or failure to follow care instructions. Adverse reactions from the use of skincare or body care products are the responsibility of the customer. Customers accept that some handmade or natural products may exhibit slight variations and imperfections that do not constitute faults.

9.               FURNITURE & BULKY ITEMS

9.1          Furniture and bulky items are sold under specific terms due to their size, fragility, and delivery requirements. Please read this section carefully before purchasing.

9.2          Change of Mind Policy: We do not accept returns or offer refunds for change of mind or incorrect selections of furniture and bulky items. Please ensure that:

     You have reviewed the product dimensions and details carefully.

     The items will fit in your intended space and through all doorways, lifts, and stairwells.

9.3          Product Appearance:

9.3.1    Colours and textures shown online may vary slightly from the actual product due to lighting, screen settings, and natural material variation.

9.3.2    Many of our furniture items are made with timber, rattan, marble, or other natural materials that will exhibit variation in grain, tone, and pattern.

9.3.3    These natural characteristics are not faults but part of each piece's unique appeal.

9.4          Delivery Requirements:

9.4.1    Delivery is available within Australia only.

9.4.2    Bulky items are excluded from flat-rate shipping offers.

9.4.3    Shipping rates are calculated at checkout based on item size, weight, and delivery postcode.

9.4.4    All furniture deliveries are to ground floor level only. If your delivery address requires stair access or elevator use, you are responsible for making suitable arrangements.

9.4.5    Our couriers are not authorised to move items into your premises beyond the delivery point or assist with assembly.

9.5          Delivery Timing:

9.5.1    Furniture items may be dispatched within 1–2 weeks of order placement unless otherwise stated.

9.5.2    Custom-made or pre-order items will be dispatched according to the estimated availability noted on the product page. These timeframes are estimates only and may be subject to change due to supplier delays.

9.6          Inspection Upon Delivery:

9.6.1    You must inspect all furniture and bulky goods upon delivery. Any damage or issues must be reported to us within 48 hours following the delivery using the same claims process outlined in Clause 7.

9.7          Responsibility:

9.7.1    We are not liable for delays due to courier or manufacturer issues outside of our control.

9.7.2    You are responsible for arranging access and ensuring safe delivery into your space.

9.7.3    If delivery fails due to inaccurate address details, lack of access, or absence at the time of delivery, re-delivery fees may apply.

9.7.4    Please contact us prior to ordering if you have questions about furniture specifications, access concerns, or delivery logistics. We are happy to assist you in making an informed purchase.

10.          LIMITATION OF LIABILITY

10.1      Loss or Theft After Delivery:
Once an order has been marked as “Delivered” by the courier or Australia Post and is confirmed as having arrived at the correct address provided, Pure Apotheca is not responsible for any loss, theft, or damage that occurs after delivery. This includes circumstances where the parcel is left unattended (e.g. at the front door, letterbox, or building foyer) in accordance with standard delivery practices.

10.2       We strongly recommend selecting a secure delivery location and/or using tracking and delivery notifications provided by the courier. You may also request signature on delivery at checkout (where available) for added security.

10.3        To the maximum extent permitted by law, Pure Apotheca excludes all liability for any direct, indirect, incidental, consequential, special, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or relating to:

     The use or inability to use our website

     Delays or disruptions in our website or ordering process

     Defects in any products purchased from us

     Incorrect or incomplete information provided by customers

     Shipping delays or failures caused by third-party courier services

10.4      This limitation applies whether the alleged liability is based on contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

10.5      We do not exclude or limit the application of any consumer guarantees, rights, or remedies you may have under the Australian Consumer Law (ACL) or any other applicable legislation that cannot lawfully be excluded or limited.

10.6      If any product is deemed to be defective, not of acceptable quality, not fit for purpose, or otherwise in breach of a consumer guarantee under the ACL, our liability is limited to one or more of the following, at our election:

a.    Replacement of the product or supply of an equivalent product

b.    Repair of the product

c.    Refund of the amount paid for the product

10.7      You agree that any claim or cause of action arising from your use of our website or purchase of our products must be brought within 12 months from the date on which the claim or cause of action arose.

10.8      Nothing in these Terms is intended to limit your rights under the ACL or to exclude any liability that cannot be lawfully excluded.

11.           INTELLECTUAL PROPERTY

11.1      All content on the Pure Apotheca website, including but not limited to product descriptions, images, graphics, logos, branding, layout, design elements, and written text, is the property of Pure Apotheca Pty Ltd or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

11.2      You may browse and view our website for personal use only. You must not:

     Reproduce, modify, copy, distribute, transmit, republish, display, or perform any part of our content without our prior written consent

     Use any of our product images or content for commercial purposes or to promote other products or services

     Claim ownership of any intellectual property found on our website

11.3      All trademarks, registered or unregistered, service marks, and trade names are the property of their respective owners. The use of any such material without express written consent is strictly prohibited.

11.4      If you believe any material on our site has been used in a way that constitutes copyright infringement, please contact us immediately with full details so we can investigate and take appropriate action.

11.5      Nothing in these Terms grants you any rights or licenses to use any content, intellectual property, or trademarks belonging to Pure Apotheca or any third parties, unless expressly authorised.

 

12.           PRIVACY

12.1      We are committed to protecting your privacy and ensuring that your personal information is handled in accordance with Australian privacy laws.

12.2      When you place an order, contact us, or use our website, we may collect personal information such as your name, contact details, billing and delivery addresses, and order history. This information is collected solely for the purpose of processing your order, delivering products, and communicating with you about your purchase.

12.3      We do not sell, rent, or disclose your personal information to third parties except where required by law or where necessary to fulfil your order (e.g. providing your delivery address to our courier service provider).

12.4      We use secure third-party payment platforms and take reasonable steps to protect your information from unauthorised access, disclosure, or misuse.

12.5      By using our website, you consent to our collection and use of your information in accordance with these Terms and our Privacy Policy.

13.          GOVERNING LAW AND DISPUTE RESOLUTION

13.1      These Terms are governed by the laws of New South Wales, Australia. Any disputes arising out of or in connection with these Terms or your purchase from Pure Apotheca shall be subject to the exclusive jurisdiction of the courts of New South Wales.

13.2      If a dispute arises, you agree to first contact us at hello@pureapotheca.com to attempt to resolve the matter amicably and in good faith. We are committed to working with you to find a fair resolution.

13.3      If the dispute cannot be resolved through direct negotiation within 30 days, the parties agree to attempt to resolve the dispute through mediation administered by the Law Society of New South Wales before resorting to litigation. Each party will bear its own legal costs and share equally in the cost of the mediation process, unless otherwise agreed.

13.4      Nothing in this clause limits your rights under the Australian Consumer Law, or your right to seek urgent injunctive relief if required.
